Contractual Terms and Conditions – Cheap Energy AB

1. On signing the contract, the Customer grants power of attorney to Cheap Energy AB, or to the party
appointed by Cheap Energy AB to act on its behalf, to terminate existing contracts and enter into contracts
with new suppliers, and to obtain information about the business from suppliers prior to start-up. In addition,
Cheap Energy AB is granted power of attorney to reactivate the Customer if notice of termination does not
exist. On signing this contract, I grant power of attorney to Cheap Energy AB to perform a change of address in
relation to my existing electricity network contract and electricity supply contract, and to invoice this as an
Energy Invoice to me. The contract period is agreed in the electricity contract, and the notice period is specified
under the terms and conditions for the various types of contract as described below. If notice of termination is
not provided by a Business Customer, or by an agent with power of attorney, before the notice period comes
into effect, the business contract automatically converts to a Variable Current Rate contract, which is a variable
price contract that is valid until further notice, with a notice period of 12 months. If notice of termination is not
provided by a Private Customer, or by an agent, before the notice period comes into effect, the Private
Customer converts to a Variable Current Rate Private contract, which is a variable price contract that is valid
until further notice, with a notice period of 1 month.
2. The Customer undertakes to purchase electricity from Cheap Energy AB at the agreed price during the contract
period.
3. The contract between the Customer and Cheap Energy AB consists of an Electricity Contract, including Cheap
Energy AB’s contractual terms and conditions and the industry’s general conditions for sale of electricity to
domestic consumers and general conditions for sale of electricity used in business operations and other similar
activities, at present EL2012K (https://www.energimarknadsbyran.se/media/1135/el-2012-k-rev-2.pdf) and
EL2012N respectively. In the event of differences, inconsistencies or ambiguities, the electricity contract,
including Cheap Energy AB’s contractual terms and conditions, shall take precedence over the industry’s
general conditions for sale of electricity to domestic consumers. Information about consumer rights is available
here: https://www.cheapenergy.se/konsumentratt/, as well as further down in these contractual terms and
conditions. Section 20 below contains information pursuant to chapter 11, section 13 of the Swedish Electricity
Act.
4. In order to be valid, any amendments or additions made by the Customer to the pre-printed text in the
contract must be approved in writing by Cheap Energy AB.
5. Cheap Energy AB may perform a credit check on the Customer, which may result in the Customer’s order
not being accepted.
6. Cheap Energy AB applies right of withdrawal pursuant to the Swedish Distance and Off-Premises Contracts
Act. A private customer may exercise this right of withdrawal by contacting customer service within 14
calendar days, although no earlier than the date on which the Customer has received the prescribed
information regarding right of withdrawal, either verbally or in writing. In order to exercise the right of
withdrawal and cancel the contract, the Customer shall contact customer service via telephone, letter or email.
The Customer may also request the standard form regarding right of withdrawal. The withdrawal form can
also be accessed at https://www.cheapenergy.se/konsumentratt/. A business customer who enters into a
contract with Cheap Energy AB does not have any right of withdrawal.
7. In connection with a move to a completely new address, Cheap Energy AB needs to receive the relevant
details at least 7 days prior to the desired supply start date. The latest2 start date for a newly signed electricity
contract is 3 months from the date of signing.
8. The contract period is specified in the Electricity Contract. Under no circumstances is Cheap Energy AB
responsible or liable for a delay to the start of supply where such delay is due to inadequate or incorrect
information from the Customer or the Customer’s agent. If the Customer has a fixed-term Electricity Contract
for a certain time period with another electricity supplier, it is the Customer’s own responsibility to arrange
any notice of termination of such contract as required and to pay any cancellation/breach fees if the existing
Contract is terminated prior to its expiry date.
9. Cheap Energy AB has the right, on unchanged terms, to transfer all or part of this contract to another party.
The Customer does not have right to transfer this contract to another party without Cheap Energy AB’s prior
written consent.
10.1. Cheap Energy AB has the right to invoice, in addition to the agreed price, any energy tax, value-added
tax and other taxes and fees determined by competent authorities as applicable at any given time. In
connection with changes to or the introduction of energy tax, value-added tax, price areas, electricity
certificates and other taxes and fees determined by competent authorities, Cheap Energy AB has the right to
adjust the invoicing to an equivalent extent without prior information to the Customer. In the event of
volume deviations against the specified annual volume, Cheap Energy AB has the right to charge the
Customer for any differences. Periods with price hedging are binding during the entire contract period. In
addition to the agreed contract price, business customers are subject to Svenska kraftnät’s fees. These fees
may vary over time, and Cheap Energy AB has the right to adjust the invoicing to an equivalent extent without
prior information to the Customer. This item is called “SvK fee” on the invoice.
10.2. When a customer has selected the optional product ”Renewable electricity”, the product supplied is
100% renewable energy, which means that 100% of the origin labelling is based on cancellation of
guarantees of origin. This means 0.000g/kWh in emissions of carbon dioxide and 0.000g/kWh in emissions
of nuclear fuel waste – 100% renewable, 0% nuclear and 0% fossil. This service and product can be cancelled at
any time by contacting customer service.
10.3. Cheap Energy AB’sstandard energy mix purchases: The Nordic residual mix for 2021 consists of 12.83
percent renewable produced electricity, 32.06 percent nuclear produced electricity and 55.11 percent fossil
produced electricity. The environmental impact for the Nordic residual mix is 371.99 g/CO2 per kWh, with
nuclear fuel waste of 0.001126 g/kWh.
11. Cheap Energy AB is not liable for any indirect losses as a result of faults, unless the damage has been
caused by gross negligence or wilful neglect on the part of Cheap Energy AB. Cheap Energy AB’s total liability is
limited to SEK 5,000 incl. VAT for each individual case. The Customer may terminate the contract with
immediate effect in the event of a material breach of contract by Cheap Energy AB. In the event of bankruptcy,
or if Cheap Energy AB stops supplying power, all obligations cease during the final balance date.
12. Notice of termination must be provided by the Customer or by an agent with valid power of attorney from
the Customer. In connection with termination that is not followed by an actual change of supplier, unless
otherwise agreed, at the expiry of the contract period the contract converts to a Variable Current Rate
contract, which is a variable price contract that is valid until further notice, with a notice period of 1 month for
private customers and a notice period of 12 months for business customers. In order for the contract to be
terminated in the correct manner, Cheap Energy AB requires separate notice of termination in relation to the
electricity supplier’s electricity contract. If a power of attorney is transferred to an electricity supplier and is to
be used for the purpose of terminating an electricity contract, a written power of attorney is required, in which
case it is important that it is clearly stated that the power of attorney relates to termination of contract. For
consumers, for the sake of security, we prefer to receive written notice of termination. However, it is also
possible to provide notice of termination via telephone or email. For business customers, such as limited
companies, trading partnerships, limited partnerships and sole traders, written notice of termination must be
submitted with the signature of the authorised signatory for the business, which shall be the same person who
is named in the contract and who signed the contract. This notice of termination must be sent by way of letter
to Cheap Energy AB’s address. With regard to business customers, Cheap Energy AB will not approve any
notice of termination provided verbally or without the signature of the authorised signatory for the business.
13. Please contact Cheap Energy AB if you intend to move. The Customer’s existing electricity contract does not
automatically accompany the Customer in connection with the move.
14. Payment of Cheap Energy AB’s invoices must be received by Cheap Energy AB no later than the due date
specified on the invoice. The payment period provided (i.e. the period between the invoice date and the due
date) is approximately 20 days. Cheap Energy AB’s reminder / late payment fees are: SEK 60 per invoice for
private customers and SEK 450 per invoice for business customers. The following types of entities are deemed
to be business customers: sole traders (business registered under the individual’s personal ID number),
limited companies, trading partnerships, limited partnerships and associations. No VAT is payable on
reminder / late payment fees. If an invoice is not paid on time, penalty interest of 18% and debt collection
fees are payable in accordance with applicable legislation. Interest is charged from the due date specified on
the invoice. If the Customer neglects their obligations regarding payment, this constitutes a material breach
of contract, and Cheap Energy AB has the right to terminate the Customer’s contract with immediate effect. If
the Customer fails to make payment of invoices in accordance with Cheap Energy AB’s contractual terms and
conditions, Cheap Energy AB has the right to terminate the Customer’s contract with immediate effect in accordance
with section 12.3 Termination in the Swedish Contracts Act.
15.1. Explanation regarding variable price contracts:
A variable price contract includes price components that are variable and vary over time. The variable electricity
price varies from hour to hour and month to month, and Cheap Energy AB’s variable electricity prices are based,
among other things, on the Nordic power exchange’s electricity price weighted with the month’s electricity
usage profile in your bidding area. The price groups correspond to the actual variable price for Cheap Energy AB
to purchase electrical energy and follow Nord Pool Spot’s hourly spot price linked to the customer’s actual
electricity usage. The electricity price consists of Cheap Energy AB’s costs for purchases of electricity and
electricity certificates, Cheap Energy AB’s cost for handling the quota obligation regarding electricity
certificates, Cheap Energy AB’s surcharge in öre/kWh and any consumption-based annual fee, and is not Nord
Pool’s spot price. The cost of electricity certificates is formed on the basis of the electricity certificate market’s
listed average price per month. The average price relates to electricity certificates for supply in connection with
the current year’s declaration, in accordance with the Swedish Electricity Certificates Act. For installations for
which consumption is settled by the hour, Cheap Energy AB’s costs for purchases of electricity relate to the
weighted average that is formed when the hourly spot price on Nord Pool for the bidding area where the
Customer’s installation is located has been weighted with the Customer’s hourly energy consumption, plus
balancing cost and fees to Nord Pool as well as Svenska kraftnät and eSett. For other installations, Cheap Energy
AB’s costs for purchases of electricity relate to the weighted average that is formed when the hourly spot price
on Nord Pool for the bidding area in which the Customer’s installation is located has been weighted with Cheap
Energy AB’s procured energy volume for supply to installations with settlement based on consumer profile
computation of the consumption in the same bidding area hour by hour, plus balancing cost and fees to Nord
Pool as well as Svenska kraftnät and eSett. In addition to the volume-weighted hourly spot price from Nord Pool
Spot, applicable fees also apply in relation to Nord Pool Spot and Svenska kraftnät. As of 29/05/2017, the
volume fee is EUR 0.04 / MWh to Nord Pool Spot and EUR 0.434 / MWh to Svenska kraftnät. Svenska kraftnät’s
balance settlement fee is EUR 0.49 / MWh, and the power reserve fee is SEK 4 / MWh for weekdays between the
hours of 06–22 during the period 16 November – 15 March. In addition to these fees, applicable guarantee
requirement costs, which Nord Pool Spot and Svenska kraftnät impose on an ongoing basis according to their own
models, also apply. In addition to this, the margin to Cheap Energy AB as agreed with the customer also applies. This
consists of a visible surcharge in öre/kWh and a fixed monthly fee per active metering point.
15.2. Terms and conditions for various types of contract:
This section contains a specification of minimum contract periods, notice periods and terms and conditions for the
various types of contracts.
Fixed Rate, Fixed Rate Renewable (fixed price contracts):
The electricity price and fixed fee are unchanged during the contract period. The minimum contract period is
agreed in conjunction with the signing of the electricity contract. Invoicing occurs in arrears on a monthly basis.
The VAT rate is 25%. The notice period for private customers is 1 months. As standard, business customers
have a notice period of 12 months, with the exception of contracts that are subject to a notice period of 24
months. A notice period of only 1 month applies to business customers with contracts with a minimum
contract period of 3, 6 or 9 months, while a notice period of 6 months applies to business customers with
contracts with a minimum contract period of 12 months. If notice of termination is not provided by a business
customer, or by an agent with power of attorney, before the notice period comes into effect, the Customer
automatically converts to a Variable Current Rate contract, which is a variable price contract that is valid until
further notice, with a notice period of 12 months. If notice of termination is not provided by a Private
Customer, or by an agent, before the notice period comes into effect, the Private Customer converts to a
Variable Current Rate Private contract, which is a variable price contract that is valid until further notice, with a
notice period of 1 month.
Variable contract price with or without a minimum contract period (Variable Rate, Variable Rate Renewable):
A more detailed specification of variable price is provided in section 15.1 above. Unless a different amount has
been agreed in the electricity contract concluded with the Customer, the standard fixed monthly fee is SEK 49
incl. VAT per month for private customers and SEK 99 excl. VAT per month for business customers. Invoicing
occurs in arrears on a monthly basis. The VAT rate is 25%. Variable price contracts are concluded with a
minimum contract period of 1 months and a notice period of 1 month for private customers and a notice
period of 6 months for business customers. The terms and conditions for variable price contracts without a
minimum contract period only apply for a period of 12 months, after which the contract converts to a Variable
Current Rate contract, which is a variable price contract that is valid until further notice. Please see our
contractual terms and conditions for our current rate contract that is valid until further notice. The discount on
variable price contracts only applies for a period of 12 months, and only with regard to new customers. If
notice of termination is not provided by a business customer, or by an agent with power of attorney, before
the notice period comes into effect, the Customer automatically converts to a Variable Current Rate contract,
which is a variable price contract that is valid until further notice, with a notice period of 12 months. If notice of
termination is not provided by a Private Customer, or by an agent, before the notice period comes into effect,
the Private Customer converts to a Variable Current Rate Private contract, which is a variable price contract
that is valid until further notice, with a notice period of 1 month.
Variable price settled by the hour:
All new customers with a variable price contract who have signed a contract on or after 01/06/2021 receive a
variable price that is settled by the hour. The electricity network operator has 3 months to make this change.
Variable price settled by the hour means that the customer has hourly metering and hourly settlement,
whereby their electricity network operator forwards the meter readings to Cheap Energy AB. Invoicing occurs in
arrears on a monthly basis and is calculated according to Nord Pool’s spot price hour by hour. This is exclusive
of the agreed surcharge, the monthly fee, electricity certificates, government fees and/or the optional product
“Norden Miljö” which the customer has agreed with Cheap Energy AB. The VAT rate is 25%. Unless a different
amount has been agreed in the electricity contract concluded with the Customer, the standard fixed monthly
fee is SEK 49 incl. VAT per month for private customers and SEK 99 excl. VAT per month for business customers.
Variable price contracts are concluded with a minimum contract period of 1 months and a notice period of 1
month for private customers and a notice period of 6 months for business customers. The terms and conditions
for variable price contracts without a minimum contract period only apply for a period of 12 months, after
which the contract converts to a Variable Current Rate contract, which is a variable price contract that is valid
until further notice. Please see our contractual terms and conditions for our current rate contract that is valid
until further notice. The discount on variable price contracts only applies for a period of 12 months, and only
with regard to new customers. If notice of termination is not provided by a business customer, or by an agent
with power of attorney, before the notice period comes into effect, the Customer automatically converts to a
Variable Current Rate contract, which is a variable price contract that is valid until further notice, with a notice
period of 12 months. If notice of termination is not provided by a Private Customer, or by an agent, before the
notice period comes into effect, the Private Customer converts to a Variable Current Rate Private contract,
which is a variable price contract that is valid until further notice, with a notice period of 1 month.
Variable Current Rate contract for private and business customers(contract valid until further notice):
The electricity price consists of Cheap Energy AB’s costs for purchases of electricity, the cost of electricity
certificates, Cheap Energy AB’s surcharge in öre/kWh and any fixed fee. The contract is a Variable Current Rate
contract, which is a contract that is valid until further notice, whereby the electricity price varies from month to
month and the price is set differently each month. The contract is not a fixed price contract but rather a
variable electricity price contract with a fixed monthly fee of SEK 49 incl. VAT for private customers and SEK 99
excl. VAT for business customers. Invoicing occurs in arrears on a monthly basis. The VAT rate is 25%. Private
customers are subject to a notice period of 1 month, while business customers are subject to a notice period of
12 months.
Micro Production contract:
Cheap Energy AB’s contractualterms and conditions in connection with the purchase of micro production from
individual consumers and companies (producers) are signed separately. Please contact our customer service for
assistance in relation to this type of contract.
16. The invoicing principle applied in Cheap Energy AB’s various types of contract for Private Customers and
Business Customers is payment in arrears. If meter readings are not provided by the network owner, Cheap
Energy AB will issue an invoice for an estimated consumption in accordance with chapter 8, section 15 of the
Swedish Electricity Act. This estimated amount will then be deducted from the correct meter readings when
these have been received. As a main principle, Cheap Energy AB has the right to charge the Customer in
arrears for electricity that has been consumed, as long as the prescriptive period for the claim has not
expired. According to applicable law, the prescriptive period is 3 years for claims relating to Private Customers
and 10 years for claims relating to Business Customers (section 2 of the Swedish Act on Limitation). Any
objections to an invoice must be submitted to Cheap Energy AB within 8 days of the due date.
17. Energy Invoice (summary invoice):
I approve the signed electricity contract and the summary invoicing service in relation to the associated
electricity network invoice and the associated terms and conditions. I grant power of attorney to Cheap Energy
AB to perform a change of address in relation to my existing electricity network contract and electricity supply
contract, and to invoice this as an Energy Invoice. This also applies to my invoices for gas, water and sewage,
pellets, district heating, district cooling, solar cell installations, telecom, broadband and all utilities. In
connection with a change of address, the new invoice address is energifaktura@cheapenergy.se. Any payment
reminders or debt collection demands for invoices that have been produced prior to the change of address will
be forwarded to the new invoice recipient. The Customer is always responsible and liable for ensuring that all
external supplier invoices are paid.
18.1. Breach fees:
If a start date is specified in this contract, the contract will be commenced by Cheap Energy AB on the
specified date. The Customer is responsible and liable for payment of any penalty/breach fees from other
electricity companies. If the Customer breaches the contract prematurely, Cheap Energy AB has the right to
follow the provisions specified in the industry’s General Conditions for Sale of Electricity, EL2012K
https://www.energimarknadsbyran.se/el/konsumentratt/regler-och-beslut/allmanna-avtalsvillkor/ and
EL2012N respectively, and is entitled to financial compensation from the Customer. The Customer shall cover any
and all financial losses suffered by Cheap Energy AB in connection with the breach of contract. The direct loss
is calculated on the basis of general claims for compensation, such as monthly fees, extra optional services B2B
and compensation per kWh. An administration fee of SEK 49 incl. VAT is added to all breach fees.
18.2. For private individuals, the direct loss is calculated on the basis of general claims for compensation,
such as monthly fees, extra optional services and compensation of 15 öre incl. VAT per kWh. Cheap Energy AB
calculates a charge per kWh incl. VAT during the remaining contract period for the estimated consumption
loss. In addition to this, the direct costs, fees, internal costs, external costs and customer loss compensation
which this breach of contract entails for us as an electricity supplier will be added to the actual breach fee.
For private individuals, the minimum breach fee amount is SEK 990 incl. VAT per installation.
18.3. Compensation from business customers is 15 öre incl. VAT per kWh during the remaining contract
period. Compensation for remaining monthly fees and extra optional services B2B is calculated in accordance
with the applicable contract. The minimum amount of compensation payable by a business customer in
connection with a breached contract is SEK 25,000 incl. VAT per installation. If a figure for annual
consumption cannot be provided for a business, a business customer will be charged a general breach fee of
SEK 25,000 incl. VAT per installation. In connection with other forms of cessation prior to expiry of the
contract, Cheap Energy AB has the right to issue a final invoice for the remaining monthly fees and the estimated
consumption that has been agreed during the contract period.
19. Disconnection:
Disconnection may occur if a private customer, business customer or organisation neglects their obligations
and this neglect constitutes a material breach of contract. Prior to disconnection, the customer shall be
requested to undertake rectification within a reasonable timeframe and shall be notified that disconnection
may occur if this is not done. If the breach of contract is due to failure by the customer to pay for transmission
of electricity, and the timeframe for requested rectification has expired, the customer shall then be sent a
payment demand requesting payment within 21 days (for private customers) or within 15 days (for business
customers) from the date on which the customer has been served the payment demand, along with
notification that disconnection may otherwise occur. Disconnection may also occur when the customer
neglects provisions in the contract regarding the electricity that the electricity network operator transmits to
the customer, where such neglect entails a right for the electricity supplier to request disconnection. The
responsibility for the existence of the right of disconnection always rests with the party that has requested the
action. Reconnection will not occur until the customer has fulfilled all obligations under the contract and has
paid reasonable compensation for the costs incurred by the electricity network operator in relation to the
actions taken regarding disconnection and reconnection. The cost of disconnection and reconnection will be
charged to the customer, and an administration fee of SEK 500 incl. VAT will be added to this invoice.

business contract automatically converts to a Variable Current Rate contract, which is a variable price contract
that is valid until further notice, with a notice period of 12 months. If notice of termination is not provided by a
Private Customer, or by an agent, before the notice period comes into effect, the Private Customer converts to a
Variable Current Rate contract, which is a variable price contract that is valid until further notice, with a notice
period of 1 month.
